U.S. Department of Education Rescinds Outdated Guidance Documents
October 27, 2017, the U.S. Department of Education announced they were rescinding 72 guidance documents from the Office of Special Education Programs (OSEP) and Rehabilitation Services Administration (RSA). In a call and further information released this week, the Department further explained the action, including the fact that many documents were no longer relevant as they were outdated or had been replaced by subsequent guidance. It is important to remember that the Individuals with Disabilities Education Act (IDEA) statute cannot be changed without Congressional action and regulations cannot be changed without public comment.
